Congressman Doug Lamborn asked a federal court to get his name back on the ballot after it was tossed by the Colorado Supreme Court. Now, the fate of the six term congressman could be decided in a U.S. District court on Monday.

Lamborn is appealing the Colorado Supreme Court ruling after he was booted off of the Republican primary ballot because a signature gatherer for his petition wasn’t a Colorado resident.

The Congressman says the residency requirement for petition circulators is unconstitutional.
